1. Acceptance of Terms

By creating an account or using CLASSHERO, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our platform.

2. Eligibility

CLASSHERO is intended for use by educational institutions, teachers, parents, and students. You must be at least 13 years old to create an account. If you are under 18, you must have parental or guardian consent. Student accounts under 13 must be created by a parent, guardian, or authorized school official.

3. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Providing accurate and current information
• Complying with all applicable laws and regulations

4. Acceptable Use Policy

You agree not to:

• Use the platform for any unlawful purpose
• Violate any intellectual property rights
• Upload malicious code, viruses, or harmful content
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to our systems
• Scrape or extract data without permission
• Impersonate others or provide false information

5. Content and Intellectual Property

You retain ownership of content you submit to CLASSHERO. By uploading content, you grant us a non-exclusive, worldwide license to use, store, and display that content solely for the purpose of providing our services. We respect intellectual property rights and expect users to do the same.

6. Subscription and Payment

Paid subscriptions are billed in advance on a recurring basis. You authorize us to charge your payment method automatically. Subscriptions renew automatically unless cancelled before the renewal date. Refunds are provided in accordance with our refund policy (see section 7).

7. Cancellation and Refunds

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. We offer a 30-day money-back guarantee for new subscribers. Refunds for partial months are not provided except as required by law or at our discretion.

8. Service Availability

We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service. We may temporarily suspend service for maintenance, updates, or security reasons. We are not liable for any losses resulting from service interruptions beyond our reasonable control.

9. Data Protection and Privacy

We are committed to protecting your data in accordance with applicable privacy laws including FERPA, COPPA, and GDPR. Our Privacy Policy explains how we collect, use, and protect your information. By using CLASSHERO, you consent to our data practices as described in the Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by law, CLASSHERO shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability shall not exceed the amount you paid us in the 12 months prior to the event giving rise to liability.

11. Indemnification

You agree to indemnify and hold harmless CLASSHERO, its affiliates, and personnel from any claims, damages, losses, and expenses arising from your use of the platform, your violation of these terms, or your infringement of any third-party rights.

12. Modifications to Service

We reserve the right to modify, suspend, or discontinue any aspect of CLASSHERO at any time. We will provide reasonable notice of material changes that negatively impact your use of the platform. Continued use after changes constitutes acceptance of the modified terms.

13. Termination

We may terminate or suspend your account immediately if you violate these terms, engage in fraudulent activity, or for any other reason at our discretion. Upon termination, your right to use CLASSHERO ceases immediately. You may close your account at any time through account settings.

14. Governing Law

These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in San Francisco, California.
